📄 Paddle Board Rental Liability Waiver

PLEASE READ CAREFULLY. THIS DOCUMENT AFFECTS YOUR LEGAL RIGHTS.

By signing and submitting this form, you (the “Participant”) agree to the following terms and conditions in exchange for the use of stand-up paddle boards, accessories, and any related equipment provided by Sup Drop Santa Cruz (operated by Sup Joe, LLC).

1. ASSUMPTION OF RISK

I acknowledge that paddle boarding, beach activities, and outdoor water sports carry inherent risks. These include, but are not limited to:

  • Drowning, injury, illness, sun exposure, fatigue, collisions, or unpredictable weather

  • Damage or loss of personal items

  • Risk of injury due to personal skill level or physical condition

I voluntarily assume all risks, known and unknown, associated with this activity.

2. PHYSICAL CONDITION

I affirm that I am physically fit and capable of using the rental equipment safely. I will not participate under the influence of alcohol, drugs, or impairing medications.

I understand that life jackets are required by law in many cases and strongly recommended at all times. I take full responsibility for using one appropriately.

3. EQUIPMENT USE

I accept full responsibility for all rented equipment during the rental period. I will return all gear in good condition or pay for replacement in the event of damage, theft, or loss. I agree to the following replacement values:

  • Paddle board: $300

  • Paddle: $40

  • Manual pump: $50

  • Backpack: $50

  • Dry bag: $30

  • Life jacket: $30

4. RELEASE OF LIABILITY

I release Sup Drop Santa Cruz and Sup Joe, LLC, along with their owners, employees, agents, and contractors, from any and all claims, liability, or damages related to personal injury, property damage, illness, or death that may occur while participating in the rental activity, whether caused by negligence or otherwise.

This waiver includes claims of negligence but does not release liability for gross negligence or intentional misconduct.

5. INDEMNIFICATION

I agree to indemnify and hold harmless Sup Joe, LLC and its representatives from any claims, lawsuits, damages, or costs (including attorney fees) resulting from my use of the rental equipment.

6. GOVERNING LAW

This agreement is governed by the laws of the State of California. Any disputes shall be resolved in the courts of Santa Cruz County, California.

7. ACKNOWLEDGEMENT

I certify that I am at least 18 years old and that I have read and understood this document in full. I am signing voluntarily. If I am signing on behalf of a minor, I affirm I am their legal guardian and assume full responsibility.
